Andrew Buchan
Andrew Buchan joined Hotchkin Hanly in 2000 and became a partner in 2005. Andrew has over 22 years’ experience in commercial litigation. He regularly appears as counsel in contested civil proceedings in Federal and State Courts and Tribunals, including arbitrations and mediations.
Andrew currently practises predominantly in the areas of building and construction litigation, providing representation and advice in relation to a broad range of building issues including copyright infringement, trade practices legislation, Worksafe prosecutions, Construction Contract Act claims and adjudications, contract drafting and review as well as general building and construction claims.

Andrew Throssell
Andrew has over 35 years’ experience acting across a diverse range of commercial areas at a high level. Andrew specialises in giving proactive commercial advice to implement transactions and resolve issues. Andrew (and Hotchkin Hanly) acts for major corporations, property owners, business owners, developers, builders and start up companies including a number of major shopping centres and CBD arcade owners. Those clients include the Perron Group, SG REIT, the BGC Group, the Humich Group and Tah Land. Andrew also supervises the conveyancing practice of Hotchkin Hanly.
Examples of major projects Andrew has worked on are the Tribeca developments at the Springs, the development and sale of the Aloft and Westin Hotels, the purchase of the Midland Brick site and business at Middle Swan and the sale of Joondalup Gate, the Swan Brewery Industrial Estate at Canning Vale, the Knutsford Development, as well as numerous smaller transactions.
Gilbert Flynn
Gilbert has more than 30 years’ experience in commercial law and litigation. Gilbert commenced practice in Perth with Bennett & Co.
After several years he joined Mallesons Stephen Jaques (now King & Wood Mallesons), practised in both Perth and Sydney for nine years before spending several years as Special Counsel (IT) at Blake Dawson Waldron (now Ashurst).
Gilbert joined Hotchkin Hanly in 2003 and became a partner from 1 January 2004. Although he has considerable experience in litigation (including banking and finance, trade practices, corporations, administrative actions (SAT, AAT), insolvency/bankruptcy and defamation), Gilbert now primarily conducts a commercial practice, specialising in, IT and IP matters, and general business transaction based commercial documentation and negotiations.
Howard Healy
Howard joined Hotchkin Hanly in 2013 and became a partner in July 2014. Between 2007 and 2012 Howard was General Counsel and Company Secretary for the WesTrac group of industrial and mining services companies. Prior to that he was a Senior Associate in Clayton Utz’s Major Projects Group and has been a practising lawyer for over 20 years.
Howard is an experienced litigator specialising in the resolution of building and construction disputes for principals, contractors and consultants as well as other general commercial disputes relating to trade practices, insurance, product liability and negligence. He also provides front-end advice to clients in the construction, industrial and mining industries on drafting and negotiating contracts. Howard is recommended by Doyles as a leading construction litigation lawyer.
Phillip Dobson
Phillip commenced his legal career in 2004 as an Associate in the Federal Court to the Honourable Justice French who would later become the Chief Justice of the High Court. After completing his Associateship, Phillip went on to work in two national law firms in Perth before joining Hotchkin Hanly. He became a partner in 2014. Phillip practices primarily in litigation and dispute resolution. He has experience in a wide range of commercial litigation including contractual disputes, planning and environment matters, competition and consumer law, negligence (and other torts), Corporations Act matters and mining and resources litigation. Phillip regularly appears as counsel in contested matters in State and Federal courts and Tribunals.
Michael Mistilis
Michael commenced his career with King & Wood Mallesons (when it was called Mallesons Stephen Jaques) where he practised in the areas of general commercial litigation and dispute resolution, insolvency, banking and finance transactions and mergers and acquisitions.
At Hotchkin Hanly Michael assists clients with commercial transactions and dispute resolution and litigation in all areas of commercial law with a particular focus on the following: building and construction (acting for developers and builders on large scale projects and disputes), property, environment, insolvency, finance, resources, Corporations Act including regulatory matters, contract, tenders and procurement, and strata titles.
Michael prepares transaction based commercial documentation and provides clients with risk management strategies and associated advice. Michael also represents clients in all of the Courts of Western Australia (including the Warden’s Court), the Supreme Court of Queensland, the Supreme Court of the Northern Territory, the Federal Court of Australia and the State Administrative Tribunal of Western Australia. Michael has appeared as lead Counsel in the Supreme Court of Appeal in Western Australia.
Michael has a Bachelor of Laws (with Honours), a Bachelor of Arts (double major: English and Philosophy), a Graduate Diploma in Legal Practice, and a Graduate Diploma in Education.
Michael was admitted to the Supreme Courts of NSW and Western Australia in 2008, and the High Court of Australia in 2010.
Nick Kalmund
Nick has over 10 years of experience practising in commercial litigation, advising and representing clients on disputes in a wide range of areas including building and construction disputes, corporations, trade practices, financial services, planning and development, minerals and resources, insolvency and leasing. He also has experience defending accused in commercial prosecutions, including building and planning prosecutions, and regulatory matters.
Nick regularly appears as counsel in the Federal, Supreme and District Courts, and has represented parties in commercial arbitrations, and conducted litigation interstate.
Nick joined Hotchkin Hanly as an Articled Clerk in 2011. He was admitted to the profession in March 2012 and promoted to Senior Associate in July 2015. On 1 July 2019, Nick became a Partner of Hotchkin Hanly. Prior to joining Hotchkin Hanly, Nick worked as a paralegal in the Office of the Director of Public Prosecutions (WA) while completing his LLB and BA.
Xian Davies
Xian has over 12 years’ experience in commercial and property related matters, and has worked with a variety of small to large corporate and individual clients on a broad range of commercial, property and corporate transactions that include leasing, business and property acquisitions and sales, property development, share and asset sales, estate planning and personal property securities.
Xian has a Bachelor of Laws and Bachelor of Arts from the University of Western Australia, and was admitted to practice in 2009.
Mark Hemery
Mark has more than 35 years’ legal experience, primarily in litigation and employment law. Prior to joining Hotchkin Hanly in 2013, Mark’s career had included practising as a litigation partner of Mallesons Stephen Jaques (now King and Wood Mallesons), as national litigation counsel for Telstra Corporation Ltd and as a barrister in private practice at the Perth bar. Mark has experience conducting litigation in all State and Federal courts up to the High Court. Throughout his career Mark’s litigation practice has been diverse, but has included litigation, contract law, commercial law, property and real estate law, statutory interpretation, trade practices and consumer law and administrative law. Mark also has substantial experience in employment law (contentious and non-contentious), an area in which he has also practiced throughout his career.
In 2019 – 2023 Mark was recognised in Doyle’s Guide as a recommended lawyer for employment law in the Perth market.
Darren Zusman
Darren joined Hotchkin Hanly in December 2022 and has over 15 years’ experience gained in corporate disputes and commercial litigation from international, national and WA based law firms. Darren has previously acted for high net wealth individuals and private companies in complex disputes involving ACCC prosecutions, arbitration, competition and consumer law, the Corporations Act, contract law, maritime law and strata title law.
Joshua Fetherstonhaugh
Josh practices in a range of dispute resolution and litigation fields, including contractual disputes, shareholder oppression matters, breach of duties matters, regulatory litigation, insolvency, building and construction matters, and land acquisition compensation claims. He works with a broad spectrum of clients, including ASX listed and private companies, company directors and high net worth individuals.
He has represented clients in disputes in the Federal Court of Australia, the Supreme Courts of Western Australia and Victoria, the County Court of Victoria, the District Court of Western Australia, the Victorian Civil and Administrative Tribunal (VCAT), the State Administrative Tribunal of Western Australia (SAT) and Australian Financial Complaints Authority (AFCA).
Josh returned to Hotchkin Hanly in the role of Special Counsel in August 2023, after spending 3 ½ years at national firm in Melbourne.
Luke Swanson
Luke practices in dispute resolution and litigation, and advises clients on commercial, employment, construction, and other civil and regulatory disputes.
Luke has experience appearing, as counsel and instructing solicitor, in the Supreme, District and Magistrates Courts of Western Australia, as well as the Federal Court and Federal Circuit Court of Australia, the Western Australian Industrial Relations Commission, State Administrative Tribunal, Fair Work Commission and High Court of Australia.
Luke joined Hotchkin Hanly Lawyers in February 2013 after a year as Associate to Justice Le Miere of the Supreme Court of Western Australia, and was admitted to practice in August 2013.
Damien Giglia
Damien practices in dispute resolution and litigation, focussing on commercial, construction, leasing and other civil disputes. Damien has appeared as counsel in the Supreme, District and Magistrates Courts of Western Australia, including defending accused in commercial regulatory prosecutions.
Damien graduated from the University of Western Australia in 2015 with a Bachelor of Laws and a Bachelor of Commerce majoring in Corporate Finance and Financial Accounting. Damien joined Hotchkin Hanly in 2015 and was admitted as a lawyer in Western Australia in March 2016.
